Who is leaving Britain and what it costs to stay

UK exit tax: current rules and continuing liabilities

The UK has no general personal exit tax (HMRC, 2026-27 rules). UK property gains, continuing income and a later return can still create a bill.

What would a UK exit tax charge?

A general departure tax could treat assets as sold when residence ends, taxing gains before an actual sale. Its rules would need to specify the assets covered, their starting values and when payment falls due.

HMRC describes continuing tax duties after departure, rather than a general exit charge (guidance dated 24 October 2026). A press proposal does not create a tax bill. See the Budget tracker for announcements and effective dates.

The October 2026 Budget proposes changes to the existing Capital Gains Tax exit charge for trusts when trustees migrate. That is a trust rule, so it does not by itself establish a general personal departure charge. The Budget also proposes a 10% Founders’ Relief on up to £10 million of qualifying lifetime gains from April 2027. Its detailed design is under consultation. Business Asset Disposal Relief’s lifetime limit is planned to fall from £1 million to £500,000 on the same date.

Which gains remain taxable after leaving?

HMRC says non-residents usually do not pay UK tax on sales of most assets, with an exception for UK property and land. Its UK income abroad guidance explains the continuing rules.

The taxable gain differs from the sale price. Purchase costs, later spending and available reliefs can affect the bill. A departure date alone supplies too little information to calculate it.

What is the five-year temporary non-residence rule?

HMRC’s HS278 helpsheet describes rules that can tax certain gains on return. They include an absence of five years or less and a prior condition of sole UK residence for all or part of at least four of the seven tax years before departure.

The full test also considers residence periods, treaty treatment and the assets involved. Some assets acquired during absence have exceptions. Count tax-residence periods under the rules before relying on a calendar anniversary.

The statutory residence guide and day counter explain the residence framework. A day count alone cannot decide every condition.

Can UK Income Tax continue abroad?

Yes. HMRC lists UK rent, pensions, savings interest and wages among income that can remain taxable. Double taxation relief can prevent the same receipt being taxed twice under the relevant rules.

A destination with no salary tax does not cancel a British liability. The tax free countries guide explains what those salary exemptions cover.

How long can Inheritance Tax exposure last?

The overseas-asset rules changed on 6 April 2025. Long-term residence generally means UK residence in at least ten of the previous twenty tax years. Exposure after departure can continue for three to ten tax years, depending on residence history and transitional rules.

HMRC’s long-term residence guidance below sets out the details. The non dom guide explains how this test differs from FIG relief.

How do I report leaving the UK?

Use P85 or Self Assessment as HMRC requires for your circumstances. Reporting the move and ending UK tax residence are separate steps. Keep departure, travel and income records using the moving abroad checklist.

What records matter if I later return to the UK?

Keep the dates residence began and ended, plus details of assets held before departure and gains made during absence. Temporary non-residence rules can bring certain receipts into tax on return. The HMRC returning-to-UK source below explains that separate assessment.
