When do you become UK tax resident again?
Apply the statutory residence test, or SRT, for the whole tax year. It considers UK days, work, homes and other ties. Spending 183 days or more in the UK meets an automatic UK test, but fewer days can still produce residence. A bank account or a British passport does not settle it.
HMRC’s residence guidance, checked 25 October 2026, supplies that day threshold. Use the SRT guide and day counter with records of travel, work and homes. UK residence normally brings overseas income and gains into scope, subject to reliefs and treaties.
Can the return year be split?
Split-year treatment divides a qualifying year into UK and overseas parts for specified tax purposes. It is conditional, rather than an automatic election to use your arrival date. Returning after a short absence may mean you never ceased UK residence.
HMRC’s residence guidance, checked 25 October 2026, explains the conditions. Use the SA109 and split-year guide for reporting and the non dom and FIG guide for the separate foreign income and gains relief rules.
Can income or gains from the absence be taxed on return?
Yes. Temporary non-residence rules can charge specified income and gains received while away. The general test includes sole UK residence in at least four of the seven earlier tax years and an absence of five years or less. Exactly five years remains inside that limit.
These conditions come from HMRC RFIG21510, manual updated 3 July 2026. The temporary non-residence article explains which receipts are caught. It is not a charge on everything earned abroad.
Can you use the NHS on return?
The Department of Health and Social Care’s return guidance, published 27 March 2019, says UK nationals returning to live here can use the NHS. Register with a local GP and keep evidence of the settled move.
For England, NHS guidance says free hospital treatment generally depends on ordinary residence, meaning lawful, settled residence, or another exemption. Past tax or NI payments and GP registration alone do not establish that entitlement. Check the relevant health service for Scotland, Wales or Northern Ireland. The linked NHS guidance was last reviewed on 25 April 2023 and checked here on 25 October 2026.
What happens to State Pension and National Insurance?
DWP’s pension guidance, checked 25 October 2026, says a pension frozen abroad rises to the current rate when you return to live in the UK. Tell the pension service about the move.
HMRC’s return guidance, checked 25 October 2026, says you usually start paying National Insurance again when working here. Check your NI record and pension forecast before deciding whether to fill gaps. The NI abroad guide and UK pension abroad guide explain the wider rules.
What banking and savings checks help?
Tell your providers about the change of address and tax residence, then check their documentation requirements. MoneyHelper’s account-opening guide, checked 25 October 2026, explains identity and address checks, including alternatives to standard documents.
HMRC says ISA subscriptions can resume when you become UK resident again, subject to the normal rules. Its ISA guidance was checked 25 October 2026. See the ISA and UK banking guide for the distinction between holding an account and paying into it.
What else do readers ask?
Does British citizenship decide my tax residence?
No. Tax residence depends on the statutory residence test. Citizenship and the right to live in the UK are separate questions.
Does the day I land always start my UK tax liability?
No. Residence is assessed for the tax year. Split-year treatment can change how the year is taxed, but only when its conditions are met.
Do past National Insurance payments guarantee NHS access?
No. NHS hospital entitlement in England depends on residence or another exemption. GP registration alone does not establish entitlement to free hospital treatment.
Will a frozen State Pension rise if I return to live in the UK?
DWP says the pension goes up to the current rate on returning to live in the UK. Notify the pension service so it can check your payments.
